Terms of Service

1. About these terms

These Terms of Service ("Terms") form a legally binding agreement between you and Tuxco Pty Ltd ("FriendBell", "we", "us"). By creating an account or using the FriendBell app, you agree to these Terms.

These Terms are governed by the laws of Australia, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and the Privacy Act 1988 (Cth).

2. Who can use FriendBell

  • You must be at least 18 years old to create an account
  • You must be the parent or legal guardian of any child you add
  • Children never hold their own account and never agree to these Terms directly

3. Parental responsibility

  • You are responsible for supervising your child's use of the app
  • You are responsible for approving every friendship and reviewing call history
  • You must ensure the other parent has also approved before a friendship becomes active
  • You must keep your account credentials secure and not share them

4. Acceptable use

You agree not to:

  • Impersonate another person or create an account for a child who is not yours
  • Use the service for harassment, abuse, grooming or any unlawful purpose
  • Attempt to reverse engineer, decompile, scrape or attack the service
  • Use the service in a way that infringes Australian law or the rights of others

We may suspend or terminate accounts that break these rules, without prior notice, to protect children on the platform.

5. Voice, video and group calls

FriendBell supports one-to-one voice calls between approved friends. Video calling and group calling (up to four children in a single call) are additional features that are off by default and can be enabled per child from the parent dashboard. A video call only proceeds when both children's parents have enabled video for their own child; a group call only proceeds when every participating child's parent has enabled group calling for their own child.

All calls are transmitted in real time and are never recorded or stored by FriendBell. Call quality depends on your device, microphone, camera and internet connection. We may impose reasonable limits (for example, on call length, group size or the number of concurrent calls) to protect the service.

6. Price

FriendBell is currently offered free of charge. If we introduce paid features in the future, we will give you clear notice and an opportunity to accept or decline before any charge applies. Core safety features will remain free.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot be lawfully excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including a guarantee that services will be provided with due care and skill.

To the extent permitted by law, our total liability to you for any loss or damage arising out of your use of the service is limited, at our option, to re-supplying the service or paying the cost of having the service re-supplied.

8. Availability and "as is" service

Subject to Section 7 above and any non-excludable statutory rights, we provide FriendBell on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or free from third-party interference.

9. Termination

You can close your account at any time from the parent dashboard, which permanently deletes all associated child profiles, friendships, schedules and call history. We may terminate or suspend an account that breaches these Terms or that is used in a way that poses a risk to children.

10. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

11. Changes to these terms

We may update these Terms from time to time. Where changes are material, we will notify parents by email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

12. Disputes and governing law

These Terms are governed by the laws of the State of [Your State], Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia. Before starting any formal proceeding, please contact us at support@friendbell.app so we can try to resolve the issue.
